In Clinical Ethics, Robert Timko argues that the moral dilemmas of clinical medical practice can best be resolved within a framework of prima facie duties, and that the most stringent duty is that of nonmaleficence. Timko shows that respect for individual autonomy and the principle of beneficence are inadequate for the moral practice of medicine since simple adherence to either principle may be insufficient for the provision of "due care.".

The topic of this paper concerns corporate responsibility and worker safety. In particular it focuses on the notions of willing and intending and how these relate to risk-taking in the workplace. I discuss the metaphysical status of the corporation, the distinction between willing and intending and the motivations of each, and Austin's distinction between accidents and mistakes in light of a single industrial accident which occurred at the Texaco Oil Refinery, Port Arthur, Texas, in October, 1982. My aim is to (...) argue that corporations do not alleviate themselves from moral responsibility in the workplace solely because they might not intend to produce harm in a given situation. (shrink)

In a recent article in this Journal Grant and Broom reported on a survey which they conducted concerning student attitudes toward ethics. They suggest that while their findings are only preliminary, such surveys can help instructors and schools to determine what type of ethical training a person from a particular demographic background might need. Likewise they may very well help a student's future employer determine the ethics he or she has based on the type of institution he or she attended. (...) However, it is my contention that there are a number of problems inherent in the process and the interpretation which Grant and Broom suggest. I discuss these problems herein. (shrink)

In January 1969, just before his inauguration as president, Richard M. Nixon attended a concert in his honor at Constitution Hall. The program consisted entirely of works by American composers, including Howard Hanson, then the director of the Eastman School of Music at the University of Rochester. Hanson's choral work “Song of Democracy,” a setting of two excerpts from poems by Walt Whitman, was the last number of the evening. Behavioral paternalism raises deep concerns that do not arise in traditional welfare economics. These concerns stem from behavioral paternalism’s acceptance of the defining axioms of neoclassical rationality for normative purposes, despite having rejected them as positive descriptions of reality. We argue that behavioral paternalists have indeed accepted neoclassical rationality axioms as a welfare standard; that economists historically adopted these axioms not for their normative plausibility, but for their usefulness in formal and theoretical modeling; that broadly rational individuals might fail to (...) satisfy the axioms for various reasons, making them unpersuasive as normative criteria; and that even if their violation did constitute irrationality, that would not justify paternalists’ choosing among inconsistent preferences to define an individual’s “true” preferences. The authors developed this textbook in response to an increasing interest in ethics, and a growing number of courses on this topic that are now being offered in educational leadership programs. It is designed to fill a gap in instructional materials for teaching the ethics component of the knowledge base that has been established for the profession. The text has several purposes: First, it demonstrates the application of different ethical paradigms (the ethics of justice, care, critique, and the profession) through (...) discussion and analysis of real-life moral dilemmas that educational leaders face in their schools and communities. Second, it addresses some of the practical, pedagogical, and curricular issues related to the teaching of ethics for educational leaders. Third, it emphasizes the importance of ethics instruction from a variety of theoretical approaches. Finally, it provides a process that instructors might follow to develop their own ethics unit or course. * Part I provides an overview of why ethics is so important, especially for today's educational leaders, and describes a multiparadigm approach essential to practitioners as they grapple with ethical dilemmas. * Part II deals with the dilemmas themselves. This survey report is a follow-up to the survey done by the Center for Business Ethics in 1984/85 which was published in the Journal for Business Ethics under the title of 'Are Corporations Institutionalizing Ethics?' (Volume 5, 1986, pp. 85-91). This 1989/90 survey was again sent to Fortune 1000 industrial and service companies to find out what they have done to build ethical values into their organizations. It reveals some interesting comparisons with the 1984/85 survey with regard to expanding efforts, (...) objectives, progress, and methods of implementation, along with some new information on their perception of public pressure for ethics programs and the need for ethics education. The survey shows where some progress in building ethics into corporations seems to be occurring and where much more work needs to be done. (shrink)

Though rapid collection of big data is ubiquitous across domains, from industry settings to academic contexts, the ethics of big data collection and research are contested. A nexus of data ethics issues is the concept of creep, or repurposing of data for other applications or research beyond the conditions of original collection. Data creep has proven controversial and has prompted concerns about the scope of ethical oversight. Institutional review boards offer little guidance regarding big data, and problematic research can still (...) meet ethical standards. While ethics seem concrete through institutional deployment, I frame ethics as produced. Informed by my ethnographic research at a large public university in the U.S., I explore ethics through two models: ethics as institutional procedures and ethics as acts and intentions. The university where I conducted fieldwork is the development grounds for a predictive model that uses student data to anticipate academic success. While students consent to data collection, the circumstances of consent and the degree to which they are informed are not so apparent, as many data are a product of creep. Drawing from interviews and participant observation with administrators, data scientists, developers, and students, I examine data ethics, from a larger institutional model to everyday enactments related to data creep. After demonstrating the limits of such models, I propose a remodeling of ethics that draws on recent works on data, justice, and refusal to pose generative questions for rethinking ethics in institutional contexts. We will show that a Bell-type inequality can be derived also from these weaker assumptions.

Why is American punishment so cruel? While in continental Europe great efforts are made to guarantee that prisoners are treated humanely, in America sentences have gotten longer and rehabilitation programs have fallen by the wayside. Western Europe attempts to prepare its criminals for life after prison, whereas many American prisons today leave their inhabitants reduced and debased. In the last quarter of a century, Europe has worked to ensure that the baser human inclination toward vengeance is not reflected by state (...) policy, yet America has shown a systemic drive toward ever increasing levels of harshness in its criminal policies. Why is America so short on mercy? In this deeply researched, comparative work, James Q. Whitman reaches back to the 17th and 18th centuries to trace how and why American and European practices came to diverge. Eschewing the usual historical imprisonment narratives, Whitman focuses instead on intriguing differences in the development of punishment in the age of Western democracy. European traditions of social hierarchy and state power, so consciously rejected by the American colonies, nevertheless supported a more merciful and dignified treatment of offenders. The hierarchical class system on the continent kept alive a tradition of less-degrading "high-status" punishments that eventually became applied across the board in Europe. The distinctly American, draconian regime, on the other hand, grows, Whitman argues, out of America's longstanding distrust of state power and its peculiar, broad-brush sense of egalitarianism. Low-status punishments were evenly meted out to all offenders, regardless of class or standing. America's unrelentingly harsh treatment of trangressors--this "equal opportunity degradation"-- is, in a very real sense, the dark side of the nation's much vaunted individualism. A sobering look at the growing rift between the United States and Europe, Harsh Justice exposes the deep cultural roots of America's degrading punishment practices. (shrink)

Digital piracy is costly to creative economies across the world. Studies indicate that anti-piracy messages can cause people to pirate more rather than less, suggesting the presence of psychological reactance. A gender gap in piracy behavior and attitudes towards piracy has been reported in the literature. By contrast, gender differences in message reactance and the moderating impact of attitudes have not been explored. This paper uses evolutionary psychology as a theoretical framework to examine whether messages based on real-world anti-piracy campaigns (...) cause reactance and whether this effect is explained by gender and pre-existing attitudes. An experiment compares one prosocial and two threatening messages against a control group to analyze changes in piracy intention from past behavior for digital TV/film. Results indicate that the prosocial message has no significant effect, whereas the threatening messages have significantly opposing effects on men and women. One threatening message influences women to reduce their piracy intentions by over 50% and men to increase it by 18%. We find that gender effects are moderated by pre-existing attitudes, as men and women who report the most favorable attitudes towards piracy tend to demonstrate the most polarized changes in piracy intentions. The practical implications of the results are that men and women process threatening messages differently, therefore behavioral change messages should be carefully targeted to each gender. Explicitly, threatening messages may be effective on women, but may have the reverse effect on men with strong favorable attitudes towards the target behavior. (shrink)

Kant used transcendental reflection to distinguish in judgment what belongs to its form and what to its material. Regarding the form of judgment, Buchdahl’s work highlights the analogies between the different levels of judgment in Kant’s transcendental ontology. He uses the explicit contingency of judgments of the system of nature to illuminate the contingency of judgments of objects in general. In the Critique of pure reason, Kant had left much of the work of judgment to the unconscious imagination. Fichte and (...) Schelling attempted to make conscious and determinate the work of the unconscious imagination, but found themselves unable to avoid a reflexive regress in trying to objectify and provide a foundation for the activity of the self in judgment. Buchdahl also clarifies the role Kant gave to the object in judgment, as the indeterminate ‘thinghood’ remaining once all forms of cognition are abstracted. Fichte represented this objective side of consciousness as the not-I, as the limit of the activity of the I, as an unconscious, alien element within consciousness. Schelling struggled to illuminate this unconscious object in judgment, to provide a construction of nature, without dissolving its positive presence into abstract formulations. This paper examines how slippery slope arguments are used, and misused, in many public policy debates -- especially in the area of bioethics. I divide the various kinds of slippery slope arguments into the following categories: 1) the logical form vs the conceptual form, and 2) the theoretical context vs the practical context. While all these various types of slippery slope arguments are found wanting, I nonetheless find a valuable role for slippery slope arguments in public debate. Not only can the influence of Gottlob Frege be found in contemporary work in logic, the philosophy of mathematics, and the philosophy of language, but his projects—and the very terminology he employed in pursuing those projects—are still current in contemporary philosophy. This is undoubtedly why it seems so reasonable to assume that we can read Frege' s writings as if he were one of us, speaking to our philosophical concerns in our language. In Joan Weiner's view, however, Frege's words (...) can be accurately interpreted only if we set that assumption aside. Weiner here offers a challenging new approach to the philosophy of this central figure in analytic philosophy. Weiner finds in Frege's corpus, from Begriffsschrift on, a unified project of remarkable ambition to which each of the writings in that corpus makes a distinct contribution—a project whose motivation she brings to life through a careful reading of his Foundations of Arithmetic. The Frege that Weiner brings into clear view is very different from the familiar figure. Far from having originated one of the standard positions on the nature of reference, Frege turns out not to have had positive doctrines on anything like what contemporary philosophers mean by "reference." Far from having served as a standard-bearer for those who take the realists' side of contemporary disputes with anti-realists, Frege turns out to have had no stake in either side of the controversy. Through Weiner's lens, Frege emerges as a thinker who has principled reasons for challenging the very assumptions and motivations that animate philosophers to dispute these doctrines. This lucidly written and accessible book will generate controversy among all readers with an interest in epistemology, philosophy of language, history of philosophy, and the philosophy of mathematics. In order the combat the growing apathy, cynicism, and indifference observed among students, the author developed a course designed to make the study of philosophy relevant, applicable, and personal for students. This paper is a detailed exposition of the structure and content of this course. Build around the theme “Exploring Moral Character,” this course focuses on the role of moral character in ethical decision making and the nature of students’ own moral character. The course is divided into four units. Designed (...) as a voyage of personal discovery for students, each unit concludes with a non-traditional writing assignment (the moral reasoning unit, for example, concludes with students writing letters to the Admiralty as witnesses to the conviction and sentencing of Billy Budd). The author discusses why the course structure and paper assignments facilitate students’ ability to make explicit and to reflect on their own moral values. In the history of philosophy, two standard critiques of the reality of modes in Spinoza’s philosophy come from Pierre Bayle and Georg Wilhelm Hegel. Both philosophers in some way assume that attributes and relations among modes constitute a shared reality in which modes participate. As a result, they assert that Spinoza’s monism leads either to an over-identification of God with contingent modes or to a limited God. In this paper, I will show how attributes and relations among modes in Spinoza’s (...) work simply explain an active modal reality; modes do not depend upon or participate in ideal relations and attributes for their existence. The result is that in Spinoza’s philosophy attributes must be seen as unreal and modal reality must be understood as primary. (shrink)

Immanuel Kant hat wie kein anderer Denker die Philosophie der Neuzeit geprägt. Aufgrund seiner überragenden Bedeutung liegen inzwischen mehrere Bände zu seinen Schriften in der Reihe "Klassiker Auslegen" vor. Kant ist im wahrsten Sinne ein universeller Denker, der sein Interesse auf nahezu alle Bereiche des menschlichen Lebens richtet. Nach ihm lässt sich dieses Interesse in drei Fragen bündeln: Was kann ich wissen? Wie soll ich handeln? Und: Was darf ich hoffen? Der Antwort auf die dritte Frage geht Kant in seiner (...) Schrift Die Religion innerhalb der Grenzen der bloßen Vernunft (1793) nach. Hier, in seiner Religionsphilosophie, setzt er, gemäß der Grundüberzeugung der Aufklärung, seine Moralphilosophie fort. Gott ist für Kant nicht mehr wie etwa in der mittelalterlichen Philosophie, auch noch bei Descartes ein Gegenstand des Wissens, sondern des Hoffens: Der moralisch handelnde Mensch hofft auf eine sinnvolle Ordnung des Weltganzen, auf einen Gott, dessen Existenz zusammen mit der Unsterblichkeit der Seele die notwendige Voraussetzung für das letzte Ziel des praktischen Handelns, für das höchste Gut, ist. Diese originelle Verbindung von zunächst als gegensätzlich Erscheinendem, von einer Moral der Autonomie mit dem Glauben an einen übernatürlichen Gott, bildet jedoch nicht das einzige Thema der Schrift. We live in an age of massive efforts to transplant Western institutions. Some of those efforts have involved the so-called "Washington Consensus"; some have involved International Human Rights; but all of them have brought the West to the rest of the world, and all of them reflect a kind of missionary drive. What are the historical sources of this legal missionizing? This Article argues that those sources long predate the twentieth century, and indeed long predate the colonial adventures that began (...) in the sixteenth century. Western law was already culturally predisposed to spread well before Iberian ships reached the Americas. In particular, Western law began, in antiquity, as city-state law, and only gradually penetrated the countryside. This colonization of the countryside by the cities took place partly under the influence of Christianity. It also reflected a centrally important event in the development of Western law: the great northward shift of the center of gravity of Western culture from the Mediterranean to trans-alpine Europe, which we can roughly date to 700-1000 C.E. The long, slow internal colonization of the countryside in the West set much of the pattern for the external colonization of the non-Western world that eventually commenced in the sixteenth century.
